These are the terms and conditions for advertising upon the Quiz My Biz Pty Ltd (“Quiz My Biz”) services for business promotion to consumers website (“the Service Site”). In applying to advertise upon the site, you are agreeing with Quiz My Biz to be bound by all the Terms and Conditions set out including all amendments to same and which are published on this site from time to time. |
1. | When advertising upon the Service, you agree to abide by these Terms and Conditions as may be amended by Quiz My Biz from time to time. |
2. | The advertiser warrants that all advertising material complies with all relevant laws, regulations and advertising codes of conduct and that publication will not give rise to any claims against or liabilities of Quiz My Biz. |
3. | The advertiser warrants that : |
4. | a) | nothing in the advertising material - | | i) | breaches the Trade Practices Act, Copyright Act, any law (Commonwealth, State or Territory) relating to defamation, therapeutic goods, tobacco products, consumer protection, fair trading and sale of goods or otherwise; | ii) | infringes the rights of any persons; | iii) | is offensive, derogatory, indecent, obscene or immoral; |
| b) | any link in the advertising material to any other website is authorized by the proprietor of such site. |

5. | You agree to pay in advance all charges in accordance with the Quiz My Biz published price list as may be amended from time to time. |
6. | You agree that the initial period of advertising pursuant to this agreement shall be for a minimum of 3 months and that any subsequent renewals shall be for a minimum of 1 month. |
7. | In the event of cancellation of your advertising no refund shall be made by Quiz My Biz. |
8. | Quiz My Biz reserves the right to review any advertisement before publication and reserves the right to withhold, withdraw or refuse to display any advertisement for any reason whatsoever either before publication or after publication. |
9. | Quiz My Biz shall not be liable for any loss or damage incurred by the advertiser as a result of any failure by Quiz My Biz, its officers or agents or employees in the process of displaying any advertisement including, without limitation : |
11. | a) | failure or delay in listing an advertisement; | b) | errors in the listing of an advertisement; | c) | any interruption or error within the service. |

12. | The advertiser is solely liable for the legal liability arising out of publication of the advertisement and indemnifies Quiz My Biz and forever holds Quiz My Biz harmless from any and all liability, loss, damages, claims or causes of action arising out of any breach by the advertiser of the representations and warranties set out in these Terms and Conditions. |
13. | Termination of this agreement will not end those provisions that are capable of surviving the end of this agreement. |
14. | This agreement is governed by the laws of Victoria. Advertisers irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of Victoria and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum. |
